Terms of Service

Effective date: July 9, 2026 Service: Childcare Alerts (the "Service"), operated by Childcare Alerts LLC ("we," "us," "our").

Please read these Terms of Service ("Terms") carefully. By creating an account, subscribing to alerts, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is — and is not

Childcare Alerts aggregates and republishes public records about licensed child care centers in Minnesota — including licensing status, inspection/visit summaries, licensing actions (such as correction orders and fine orders), and, where the state has determined maltreatment, public investigation memoranda. We collect this information from public government sources and present it, along with links to the official records, so you can find it more easily and receive notifications when new records are posted.

The Service is an information tool, not a safety certification. We do not inspect child care centers, investigate complaints, verify the accuracy of government records, or evaluate the quality or safety of any center. Nothing in the Service is a recommendation, endorsement, rating, warning, or judgment by us about any center. The absence of a record in the Service does not mean a center is safe, compliant, or free of problems, and the presence of a record does not by itself establish wrongdoing. You must review the official government records and make your own decisions.

2. Accuracy, timeliness, and source data

The information in the Service originates from government agencies and third-party public sources. Government data may be incomplete, delayed, superseded, corrected, or removed at any time, and our copy may lag behind the official source. We present information "as is" and make no representation or warranty regarding its accuracy, completeness, timeliness, or fitness for any purpose. Every record we display is timestamped and linked to its official source; the official government record always controls. If you believe a record is inaccurate, contact the issuing government agency — we cannot change official records.

3. Not affiliated with the government

Childcare Alerts is an independent private service. We are not affiliated with, endorsed by, or acting on behalf of the Minnesota Department of Children, Youth, and Families, the Minnesota Department of Human Services, or any government agency.

4. Accounts and alerts

To receive alerts you provide an email address and select the centers you wish to follow. You are responsible for the accuracy of your information and for activity under your account. Alert emails include a link to unsubscribe; you may unsubscribe at any time. We may verify your email address before sending alerts.

5. Acceptable use

You agree not to: (a) use the Service to harass, defame, threaten, or intimidate any center, provider, or individual; (b) use the data to make decisions prohibited by law (for example, unlawful discrimination); (c) scrape, resell, or redistribute the Service's data except as expressly permitted; (d) misrepresent the information (for example, presenting an old or rescinded record as current); or (e) interfere with or attempt to gain unauthorized access to the Service. You are solely responsible for how you use and share information obtained from the Service.

6. Subscriptions, billing, and cancellation

Some features — including following centers and receiving alerts — require a paid subscription. Pricing and billing frequency (monthly or annual) are shown at the time of purchase. Subscriptions renew automatically at the then-current price until canceled. Payments are processed by our third-party payment processor; we do not receive or store your full payment card details.

You may cancel at any time through your account or the billing portal. Cancellation stops future renewals, and your paid access continues through the end of the current billing period. Except where required by law, payments are non-refundable, including for partial billing periods. If we offer a free trial, you will not be charged if you cancel before the trial period ends. We may change our prices on a going-forward basis with notice before your next renewal.

7. Disclaimer of warranties

THE SERVICE AND ALL INFORMATION IN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY RECORD IS CURRENT OR COMPLETE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILDCARE ALERTS LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY INFORMATION IN IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Childcare Alerts LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use or misuse of the Service or your violation of these Terms or of any law or third-party right.

10. Changes to the Service and these Terms

We may modify or discontinue the Service, and may update these Terms, at any time. Material changes will be posted with a new effective date; your continued use after changes take effect constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@childcarealertsapp.com and try in good faith to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Minnesota, and you consent to the personal jurisdiction of those courts.
